Abstract

This article sets out the main results of a doctrinary and essentially jurisprudential investigation, developed in order to clarify the origins, sense, evolution and scope of threat hypothesis as a precondition in case of affectation of constitutional rights protected by the “Acción de Protección”. The analysis, based on the positions of different authors and judicial pronouncements over the years, related to this matter, enables the authors to propose a concept of threat and to define its elements.
